Statement by Edward J. McElroy
President,  American Federation of Teachers
on U.S. Court of Appeals Decision on Union Status of Faculty


The U.S. Court of Appeals for the District of Columbia Circuit sent back to the National Labor Relations Board a case involving the union status of faculty at Point Park University, a private institution in Pittsburgh.  The court said that the NLRB failed to adequately explain its contention that faculty at Point Park University should not be considered managerial and therefore are eligible for union rights.

WASHINGTON, D.C. – Whatever decisions college faculty members make in the course of their duties are strictly professional, not managerial.  There is little difference in the professional work of faculty at public and private higher education institutions.  Faculty at private universities should not be artificially considered managerial and therefore ineligible for union rights.
